Kazaa's New: "'No Spyware' Policy" mentions,
"The certified Kazaa Media Desktop (KMD) software is provided by Sharman Networks and made available on Kazaa.com or Download.com and it contains NO spyware. Sharman Networks does not condone the use of spyware nor support the distribution of spyware to others."

LOL! iMesh claims the same. They can say that its not spyware because it technically doesnt spy on you, or their privacy policy states they dont use any info that their software sends back to them.

Ok, so its not spyware, its spamware. They install lots of software designed to sit in the background, hijack internet explorer, and ram random popup advertising down your throat continually. It's malicious either way.

From their FAQ:

i must say im impressed that download.com aint removing kazaa and putting up k-lite instead. Many millions of people who dont know better have downloaded kazaa and is using it this very moment.
