Court Rejects Suit Against Web Song-Swappers

WASHINGTON (Reuters) - A federal court denied a request to shut down Internet song-swapping services Grokster and Morpheus on Friday, handing a stunning setback to the record labels and movie studios that have sought to curb unauthorized downloading of their works.

U.S. District Court Judge Stephen Wilson said the two services should not be shut down because they cannot control what is traded over their systems. Like a videocassette recorder, the software in question could be used for legitimate purposes as well as illicit ones, he said.

"It is undisputed that there are substantial noninfringing uses for (the) Defendants' software," wrote Wilson, who serves in Los Angeles.

A recording-industry trade group involved in the case said it would appeal.

Rattled by last week's Grokster ruling, the RIAA has stepped up its psyops by spamming IM users with warning messages.

The messages are sprayed around the file sharing networks using the built-in chat function. One ominous message is intended to give the impression that the Pigopolists' Police are watching your every move:-

[You] "are not anonymous and you can easily be identified."

Sun Microsystems employees have been caught with their hands in the file-trading cookie jar, and the Recording Industry Association of America (RIAA) is not happy about it.

The RIAA sent a "cease and desist" order to Sun after discovering that some of the server makers' employees had been downloading copyrighted files at work. This is part of a broad attack by the RIAA against college students, the military and companies.

Has anyone heard about Macintosh's new program? It is a downloading music place where you can go and (now don't fall out of your computer chairs peeps) and all for $.99 each! I heard this on a television station in the background while I was surfing and didn't get it all but I thought it hilarious anyway!

Apple Computer seems to have struck a chord with the online music community, but many wonder what effect its plans will have on file swapping and Windows.
Apple unveiled its latest line of digital music products, including a long-awaited Internet music store and ultrathin versions of its popular iPod portable MP3 player. The iTunes Music Store is launching with a library of 200,000 tracks, with participation from all five of the major record labels. In addition, the store will list exclusive tracks from 20 artists, including Bob Dylan and U2.

The songs cost 99 cents each to download, with no subscription fee, and include the most liberal copying rights of any online service to date. CEO Steve Jobs also unveiled new ultrathin iPod models, advertised as being as thick as two CD cases together. The devices come with 10GB, 15GB and 30GB of storage, costing $299, $399 and $499, respectively

Songs are available only for the Macintosh running the OS X operating system and for iPod, although older versions of iPod require a software upgrade. Jobs said a version for Microsoft's Windows operating system is in the works and is expected to launch by the end of the year.
