AMD gives reasons for not opposing ATI subpoena
There are more subpoenas to come....

CHIP FIRM AMD, engaged in a "Bleak House" style antitrust case against Intel, explained to the presiding judge why it hasn't opposed Intel's request to subpoena ATI.


AMD is taking over ATI, subject to the shareholders of the firms giving them the thumbs-up. Intel thinks the case might be altered if that happens. See Intel asks judge to subpoena ATI in AMD case.

AMD lawyers said that while the cut off date for third party documents was the 22nd of June, it is "generally confined to documents generated in connection with the AMD-ATI merger, not all documents in ATI's files that may be relevant to this lawsuit", despite the "sweeping" nature of Intel's proposed subpoena.

While AMD and the class action plaintiffs don't view all the information requested as appropriate, it doesn't think the nature of the subpoena breaches the production rules set by the court. "Like Intel, they [AMD and the class plaintiffs] too expect from time-to-time to serve additional corporate third party subpoenas seeking targeted document discovery concerning specific issues that may arise during the course of the litigation." So basically, if you thought the world+dog had already received subpoenas in the case, there may well be more parties summoned to the bar in the case.
