All bets are off, Apple and AT&T. As we previously said (http://technologyexpert.blogspot.com...es-legal.html), AT&T's threats against anyone would not hold water if the software unlocking code was released as freeware or open source. This is because the exemption to the DMCA (.PDF (http://www.copyright.gov/fedreg/2006/71fr68472.pdf)) regarding software unlocking specifically says:

Computer programs in the form of firmware that enable wireless telephone handsets to connect to a wireless telephone communication network, when circumvention is accomplished for the sole purpose of lawfully connecting to a wireless telephone communication network.
